Filing 3 MINUTE entry before the Honorable Manish S. Shah: Plaintiffs' complaint does not adequately allege subject-matter jurisdiction. Citizenship of individuals is based on domicile, not residence. An allegation of residence is therefore deficient. Heinen v. Northrop Grumman Corp., 671 F.3d 669, 670 (7th Cir. 2012). Citizenship of an LLC is based on the citizenship of the LLC's members (the LLC's principal place of business does not define its citizenship). See Thomas v. Guardsmark, LLC, 487 F.3d 531, 534 (7th Cir. 2007). The complaint refers to jurisdiction arising under federal law, and mentions Section 1981, but the complaint does not bring a claim under Section 1981. The counts of the complaint are labeled as state-law claims. Plaintiffs must file an amended complaint adequately alleging subject-matter jurisdiction by 9/8/22. If no amended complaint is filed, the case will be dismissed and closed without prejudice for lack of jurisdiction. Notices mailed. (psm, ) |
