August 23, 2022 Opinion or Order Filing 7 ORDER: The Court dismisses this action for Plaintiff's failure to pay the required filing fee when initiating the action and for his failure to disclose his "struck out" status. Because Plaintiff improperly initiated this lawsuit on behalf of an estate and the individuals encompassed by the "etal." designation, the Court dismisses the action without prejudice to the estate's (or the other individuals') ability to pursue claims stemming from the alleged events before a proper tribunal. As discussed below, the Court also orders Plaintiff to pay (and the facility having custody of him to automatically collect and remit) to the Clerk of Court 100% of any and all deposits to Plaintiff's account until his filing fees have been paid in full. The Court directs the Clerk of Court to send a copy of this order to the trust fund officer at Plaintiff's present place of incarceration and to this court's fiscal department. Plaintiff is warned that, should he continue to initiate lawsuits in disregard of his obligations to this Court, the Court will recommend to the Executive Committee that he be barred from any future filings until he has paid his outstanding filing fees in full. July 28, 2022 Opinion or Order TEXT ORDER entered by Judge Michael M. Mihm on 7/28/2022. Plaintiff filed a Complaint #1 against the Village of Maywood, the Mayor of Maywood, the Maywood Police Department, and detectives and police officers employed by the Maywood Police Department. Venue for federal civil rights actions is governed by 28 U.S.C. 1391(b), which states that such actions may be brought only in (1) the judicial district where any defendant resides (if all defendants reside in the same State), (2) a judicial district in which a substantial part of the events or omissions giving rise to the claim occurred, or (3) a judicial district in which any defendant may be found, if there is no district in which the action may otherwise be brought. It appears that a substantial part of the events or omissions giving rise to the claims in this lawsuit occurred in Maywood located in Cook County, Illinois, which is situated in the federal judicial district of the Northern District of Illinois Eastern Division. 28 U.S.C. 93(a)(1). The Court finds that venue over this proceeding is in the Northern District, and that it is in the interests of justice that this cause be transferred there. 28 U.S.C. 1404(a). No summons shall issue in this action unless directed by the transferee court. The Clerk is directed to transfer this case to the U.S. District Court for the Northern District of Illinois.
