Date Filed Document Text
October 6, 2022 Filing 15 MINUTE entry Plaintiff Mattie Lomax (Lomax) has filed a Complaint #1 , a motion for a First Amended Complaint #11 , two separate IFP applications #3 #10 , and a motion for attorney representation #4 . For the reasons stated herein, the complaint is dismissed without prejudice. Lomax's applications to proceed IFP #3 #10 are denied as moot and Lomax's motion for attorney representation #4 is denied without prejudice. Lomax must file an amended complaint and a renewed in forma pauperis petition consistent with this Order by 11/17/2022. Failure to do so will result in dismissal of the case. The Court recommends that Lomax utilize the resources provided by the U.S. District Court Hibbler Memorial Pro Se Assistance Program in preparing an amended complaint, which can be found here: https://www.ilnd.uscourts.gov/Pages.aspx?/2+UWDbtVzCDq3Lu8BusuQ==. Mailed notice (axc).
October 6, 2022 Filing 14 MINUTE entry before the Honorable Franklin U. Valderrama: For the reasons stated in the Court's previous order #13 , Plaintiff's motion for leave to file #11 is denied. Plaintiff's Motion to Combine Case Filed on 09/09/2022 #12 is denied because Plaintiff appears to be asking the Court to combine a case that is already before the Court involving the Plaintiff's landlord-tenant dispute. The Court also strikes the consent to proceed before the magistrate judge #7 , as that filing needs to be a joint filing agreed upon by all parties. Defendants have not appeared on this case because the Court has denied Plaintiff's IFP applications. To help clarify the record, the Court repeats the first paragraph of its previous order about Plaintiff's IFP applications #13 in the next minute entry. Mailed notice (axc).
