| Filing 8 MINUTE entry before the Honorable Matthew F. Kennelly: This case was filed in this court (or removed to this court) by a pro se plaintiff Mr. Shedrick Bowes-Northern. The documentation is a bit confusing. The initial filing was entitled as a notice of removal. It appeared to be attempting to remove a state criminal case to federal court. If that is so the "removal" was inappropriate. A state criminal prosecution cannot be removed to federal court. So to the extent Mr. Bowes-Northern is attempting to remove the state court criminal case the Court hereby remans that case to the Circuit Court of Cook County Criminal Division. Later documentation filed by plaintiff - specifically the document entitled "amended complaint" (dkt. no. 5) makes it appear that what Mr. Bowes-Northern may actually be trying to do is to file a federal civil rights case alleging that the state criminal case was filed in retaliation for an earlier lawsuit that he filed. The Court will therefore treat this case as a newly filed pro se lawsuit under 42 USC 1983 and will deal with Mr. Bowes-Northern's application to proceed in forma pauperis in due course.
