September 6, 2022 Filing 7 MINUTE entry before the Honorable Manish S. Shah: The application to proceed without prepayment of filing fees #4 is granted. The motion for attorney representation 6 is denied without prejudice. Plaintiff did not disclose any efforts to try to find a lawyer on her own. The court will not recruit a lawyer to represent plaintiff until she first tries to find one on her own and explains why she was unable to find one. In other words, plaintiff must answer Question 2 on the court's form motion. In addition, there is no right to court-appointed counsel in civil cases. Plaintiff is a college graduate and seems to have been able to pursue her administrative remedies without counsel. At this early stage in the case, recruiting counsel for plaintiff is not necessary. If the case gets to a stage that it too complicated for plaintiff to manage, she may file another motion. Summons will not issue. The complaint is dismissed without prejudice and plaintiff may file an amended complaint by October 4, 2022. Although the complaint does check the boxes to allege types of employment discrimination, plaintiff should provide slightly more detail to put the defendant on notice of what privileges were given to white workers and how her religious rights were violated with words. The description plaintiff has provided is not enough to state a claim because it does not plausibly allege a materially adverse employment action and offers no allegation beyond a conclusory one about religious discrimination. Plaintiff is not required to provide evidence or include every detail in a complaint, but must provide enough to allow the court and the defendant to understand the nature of her claim. If plaintiff does not file an amended complaint by October 4, 2022, the case will be dismissed with prejudice for failure to state a claim. Notices mailed. (psm, )
