A motion to dismiss a complaint does not automatically result in a stay of discovery; several factors must be weighed. See generally Robinson v. Walgreen Co., 2021 WL 2453069, at *2 (N.D. Ill. Gottschall: The notification of affiliates #10 filed by defendant Credit Solutions, LLC, states that "[n]o publicly traded company owns 10% or more of its stock." Effective May 5, 2022, Local Rule 3.2(a)'s definition of affiliates was amended as follows: "For purposes of this rule, 'affiliate' is defined as any entity or individual owning, directly or indirectly (through ownership of one or more other entities), 5% or more of a party." See N.D. Ill. Gen. Order No. 22-0009 (May 5, 2022). Under this definition, all entities and persons meeting the definition of affiliate must be identified regardless of whether the disclosing party's stock is publicly held.
