Gottschall: Plaintiff and defendants disagree about whether discovery should commence while defendant Synchrony Financial's motion to dismiss the complaint against it (but not co-defendant Credit Solutions, LLC) is being briefed and decided. The parties have not given the court enough information in their status report #16 to determine whether staying discovery is appropriate. A motion to dismiss a complaint does not automatically result in a stay of discovery; several factors must be weighed. See generally Robinson v. Walgreen Co., 2021 WL 2453069, at *2 (N.D. Ill. Gottschall: The notification of affiliates #10 filed by defendant Credit Solutions, LLC, states that "[n]o publicly traded company owns 10% or more of its stock." Effective May 5, 2022, Local Rule 3.2(a)'s definition of affiliates was amended as follows: "For purposes of this rule, 'affiliate' is defined as any entity or individual owning, directly or indirectly (through ownership of one or more other entities), 5% or more of a party." See N.D. Ill. Gen. Order No. 22-0009 (May 5, 2022). Under this definition, all entities and persons meeting the definition of affiliate must be identified regardless of whether the disclosing party's stock is publicly held. Gottschall: The agreed motion #7 for an extension to and including 10/13/2022 of defendants' deadline to answer or otherwise respond to the complaint is granted. The parties' joint initial status report is due on or before 10/27/2022. In conformity with General Order 21-0027 and due to the need for social distancing during the COVID-19 pandemic, this court is ordering written status reports instead of routine oral status hearings. This includes initial status hearings and scheduling conferences under Fed. R. Civ. P. 16(b). See Judge Gottschall's website for the procedure for requesting a hearing and for requirements for status reports and discovery plans during the COVID-19 pandemic. No Rule 26(f) discovery plan should be submitted until all defendants have been served.
