The AON entities allege that Defendants David Knopping and Robert Surdel breached and threaten to breach their Restricted Stock Unit Agreements, which contain restrictive covenants and other agreed terms. According to AON, defendants left AON in December 2021 and formed a competitor, Alpine. The response is due by September 21, 2022. Sometimes motions for a TRO require immediate, emergency attention. Other times, there is a sense of urgency, but a plaintiff does not need an immediate ruling. The complaint alleges that Defendant Knopping is a resident of California, and that Defendant Surdel is a resident of Massachusetts. But for jurisdictional purposes, the question is a party's citizenship, not residence. See RTP LLC v. ORIX Real Estate Capital, Inc., 827 F.3d 689, 692 (7th Cir. 2016) ("Citizenship depends not on residence but on domicile, which means where a person intends to live in the long run. It is possible to reside in one state while planning to return to a long-term residence in another state."). Plaintiffs must file a supplemental jurisdictional statement by September 16, 2022, confirming their citizenship to the best of Plaintiffs' knowledge.
