MINUTE entry before the Honorable Jeffrey Cummings: This case has been reassigned to this Court for all further proceedings pursuant to the parties' consent set forth in their recently filed joint status report [18, 19]. For the record, the parties shall also promptly file a signed "Consent to Exercise of Jurisdiction by a United States Magistrate Judge" form, available on the ILND website. The Court has reviewed the parties' joint status report #18 and the District Court's minute order #17 setting a briefing schedule on plaintiff's motion to dismiss #16 . The 11/28/22 deadline for defendant's response to plaintiff's motion to dismiss and the 12/19/22 deadline for plaintiff's reply stand. The Court adopts the parties' proposed fact discovery schedule as follows: parties shall exchange Rule 26(a)(1) disclosures by 12/2/22; parties shall issue first set of written discovery requests by 1/6/23; and fact discovery shall be completed by 3/31/23. The parties report they do not anticipate expert discovery and that they are interested in a settlement conference. By 12/20/22, the parties shall file a joint status report on discovery setting forth what discovery has been completed, what discovery remains, and whether any discovery disputes require the Court's attention. In their status report, the parties shall address the issues set forth in the first paragraph of the second page of the Court's Standing Order For Settlement Conferences, state whether the parties would prefer that another Magistrate Judge conduct the settlement conference given that this is a non-jury case, and provide the dates that the parties are mutually available in January and February 2023 for a remote video settlement conference. The deadlines for the submission of settlement letters described in the Standing Order and the date for the settlement conference will be promptly set after the joint status report is received.
