October 17, 2022 Opinion or Order Filing 7 ORDER: Plaintiff's application to proceed in forma pauperis #6 is granted. The trust fund officer at Plaintiff's place of incarceration is authorized to deduct $3.70 from Plaintiff's account as the initial partial payment of the filing fee and to continue making deductions in accordance with this order as set forth below. The Court directs the Clerk to: (1) send a copy of this order of the facility having custody of Plaintiff (electronically if possible) and to the Court's Fiscal Department. However, summonses shall not issue. Plaintiff's complaint #1 is dismissed without prejudice for failure to state a claim pursuant to 28 U.S.C. 1915A. If Plaintiff wishes to pursue this litigation, by November 14, 2022, Plaintiff must submit: (1) an amended complaint; and (2) a separate completed USM-285 service form for each Defendant named in the amended complaint. If he fails to submit those items by that date, the Court will summarily dismiss this case for failure to state a claim on which relief may be granted. The Clerk is directed to send a copy of this order to Plaintiff, along with an amended civil rights complaint form, and a blank USM-285 (Marshals Service) form.
