Filing 5 ORDER: Petitioner Brochers Isom filed a pro se 28 U.S.C. 2254 habeas corpus petition challenging his convictions of attempt first degree murder and aggravated domestic battery. He seeks leave to proceed without payment of the $5.00 filing fee. Isom's prisoner trust account statement included with his in forma pauperis application shows that he clearly has an ability to pay the $5.00 filing fee.1 For this reason, the Court denies his application for leave to proceed in forma pauperis #3 . He must pay the filing fee to proceed with this case, which he may do by check or money order made payable to Clerk, United States District Court, Northern District of Illinois. Isom's failure to comply with this order by December 5, 2022 will result in summary dismissal of this habeas action without prejudice. See LR 3.3(f). The Court also denies without prejudice Isom's motion for appointment of counsel #4 . Counsel is recruited in habeas proceedings for evidentiary hearings or if justice so requires. See Rule 8(c) of the Rules Governing 28 U.S.C. 2254 Cases. The need for counsel typically cannot be made until after a response to the habeas petition has been filed. The Clerk is directed to substitute Tiffanie Clark, Warden of Illinois River Correctional Center, as Respondent and to update the case caption to Isom v. Clark. Signed by the Honorable Matthew F.
