December 28, 2022 Opinion or Order Filing 5 ORDER: DuPage County detainee Daniel Boyd sent a letter and his medical records to the United States District Court for the Central District of Illinois, which construed the submissions as a complaint and transferred the case here. By order dated November 8, 2022, this Court advised Plaintiff that he must submit an actual complaint and either pay the Court's filing fee or apply to proceed in forma pauperis if he wanted to proceed further. R. #4 . Plaintiff did not respond, and the time to do so has passed. Accordingly, the Court directs the Clerk of Court to administratively terminate this case. It is unclear whether Plaintiff intended to initiate a lawsuit, so the filing fee is waived. Any claims suggested in Plaintiff's submissions are dismissed without prejudice. This case is closed. November 8, 2022 Opinion or Order Filing 4 ORDER: After Plaintiff Daniel Boyd, a DuPage County detainee, sent a letter and his medical records to the United States District Court for the Central District of Illinois, the Central District construed the submissions as a complaint and transferred the case here. If Plaintiff wants to proceed further, he must do two things: (1) submit a complaint using this Court's form and (2) either pay the $402.00 filing fee or submit a properly completed and supported application for leave to proceed in forma pauperis. Failure to comply by 12/8/2022 will result in summary dismissal of this action. The Court directs the Clerk of Court to update the docket to reflect Plaintiff's inmate identification number before sending him a copy of this order along with an amended civil rights complaint form, a blank application for leave to proceed in forma pauperis, and instructions. November 1, 2022 Opinion or Order TEXT ORDER entered by Judge Michael M. Mihm on 11/1/2022. Plaintiff filed a Complaint #1 under 42 U.S.C. 1983 alleging violations of his constitutional rights at the DuPage County Jail. Venue for federal civil rights actions is governed by 28 U.S.C. 1391(b). According to that statute, such actions may be brought only in (1) the judicial district where any defendant resides (if all defendants reside in the same State), (2) a judicial district in which a substantial part of the events or omissions giving rise to the claim occurred, or (3) a judicial district in which any defendant may be found, if there is no district in which the action may otherwise be brought. It appears that a substantial part of the events or omissions giving rise to the claims in this lawsuit occurred at the DuPage County Jail located in DuPage County, Illinois, which is situated in the federal judicial district of the Northern District of Illinois Eastern Division. See 28 U.S.C. 93(a)(1). The Court therefore finds that venue over this proceeding is in the Northern District, and that it is in the interests of justice that this cause be transferred there. See 28 U.S.C. 1404(a). No summons shall issue in this action unless directed by the transferee court.
