Filing 10 ANNUAL REMINDER: Pursuant to #Local Rule 3.2 (Notification of Affiliates)#, any nongovernmental party, other than an individual or sole proprietorship, must file a statement identifying all its affiliates known to the party after diligent review or, if the party has identified no affiliates, then a statement reflecting that fact must be filed. An affiliate is defined as follows: any entity or individual owning, directly or indirectly (through ownership of one or more other entities), 5% or more of a party. The statement is to be electronically filed as a PDF in conjunction with entering the affiliates in CM/ECF as prompted. As a reminder to counsel, parties must supplement their statements of affiliates within thirty (30) days of any change in the information previously reported. This minute order is being issued to all counsel of record to remind counsel of their obligation to provide updated information as to additional affiliates if such updating is necessary. If counsel has any questions regarding this process, this #LINK# will provide additional information. Signed by the Executive Committee on 12/29/2022: Mailed notice. (tg, ) |
Filing 9 MINUTE entry before the Honorable Mary M. Rowland: The deadline of 1/23/23 for parties to file a joint initial status report #6 is re-set to 2/27/23. Mailed notice. (dm, ) |

Filing 7 ATTORNEY Appearance for Plaintiff Hartford Underwriters Insurance Company by Michael John Duffy (Duffy, Michael) |
Filing 6 MINUTE entry before the Honorable Mary M. Rowland: On or before 1/23/23, the parties shall file a joint initial status report. A template for the Initial Status Report, setting forth the information required, may be found at http://www.ilnd.uscourts.gov/Judges.aspx by clicking on Judge Rowland's name and then again on the link entitled 'Initial Status Conference.' The litigants are further ordered to review all of Judge Rowland's standing orders and the information available on her webpage. The court will enter a scheduling order in response. Mailed notice. (dm, ) |
Filing 5 MINUTE entry before the Honorable Mary M. Rowland: Plaintiff's motion for extension #4 is granted. In addition, Plaintiff's motion establishes, at least for pleading purposes, that the parties are completely diverse in citizenship. Thus, Plaintiff has now complied with the Court's order #3 directing it to file a jurisdictional supplement. Mailed notice. (dm, ) |
Filing 4 MOTION by Plaintiff Hartford Underwriters Insurance Company for extension of time to file Motion for Extension of Time to Provide Supplemental Statement of Diversity Jurisdiction and Statement of Same (O'malley, Michael) |
Filing 3 MINUTE entry before the Honorable Mary M. Rowland: In light of Plaintiff's invocation of diversity as the basis for federal jurisdiction #1 , on or before 12/6/22, Plaintiff shall file a jurisdictional supplement, as a separate docket entry. Plaintiff is reminded that for the Defendant LLC, Plaintiff "must identify the citizenship of each of its members as of the date the complaint or notice of removal was filed, and, if those members have members, the citizenship of those members as well." Thomas v. Guardsmark, LLC, 487 F.3d 531, 534 (7th Cir. 2007). Allegations of negative citizenship or citizenship of "another state different from the Plaintiff" are insufficient in the Seventh Circuit. See Dalton v. Teva N. Am., 891 F.3d 687, 690 (7th Cir. 2018). Failure to file the jurisdictional supplement as directed may result in the dismissal of this case for lack of jurisdiction. Mailed notice. (dm, ) |
