Filing 10 ANNUAL REMINDER: Pursuant to #Local Rule 3.2 (Notification of Affiliates)#, any nongovernmental party, other than an individual or sole proprietorship, must file a statement identifying all its affiliates known to the party after diligent review or, if the party has identified no affiliates, then a statement reflecting that fact must be filed. An affiliate is defined as follows: any entity or individual owning, directly or indirectly (through ownership of one or more other entities), 5% or more of a party. The statement is to be electronically filed as a PDF in conjunction with entering the affiliates in CM/ECF as prompted. As a reminder to counsel, parties must supplement their statements of affiliates within thirty (30) days of any change in the information previously reported. This minute order is being issued to all counsel of record to remind counsel of their obligation to provide updated information as to additional affiliates if such updating is necessary. Filing 9 MINUTE entry before the Honorable Gabriel A. Fuentes: This matter coming before the magistrate judge on referral for discovery supervision (doc. #8 ), the Court has reviewed the parties' status report (doc. #6 ) and the district court's initial order setting the Rule 26(a)(1) disclosure service date at 1/31/23. That date stands, insofar it appears sufficient to allow time for retention of new plaintiff's counsel. Further, the Court enters the following discovery schedule as modified by the Court from the schedule proposed by the parties in the status report, in which plaintiff acknowledged the need to bring in new counsel: (1) written discovery requests to be served no later than 2/28/23; (2) fact discovery cutoff of 6/30/23; (3) Rule 26(a)(2) expert disclosure reports due to be exchanged no later than 7/31/23; and (4) from all expert witnesses deposed no later than 8/30/2023, the close of all discovery. The parties are further directed to review the Court's Standing Order for Civil Cases Before Magistrate Judge Fuentes and the Top Ten Ways to Defeat Settlement, both available on the Court's website. Filing 7 MINUTE entry before the Honorable Edmond E. Chang: On review of the status report, R. 6, the Plaintiff shall promptly follow-up on retaining new counsel and new counsel shall promptly file the appearance after retention. The report says that the waiver of service was signed on 12/08/2022, but the answer deadline is not clear because that depends on when the waiver was sent, Fed. R. Civ. P. 4(d)(3). In any event, for now Rule 26(a)(1) disclosures are due on 01/31/2023 as proposed. Rule 16(b) deadline to add parties or amend pleadings is 04/10/2023. Discovery supervision (including the authority to adjust all deadlines) is otherwise referred to the magistrate judge. **No summary judgment motion may be filed before the close of fact discovery without prior authorization of the Court.** The tracking status hearing of 12/16/2022 for Judge Chang is reset to 02/10/2023 at 8:30 a.m., but to track the case only (no appearance is required, the case will not be called). Filing 5 MINUTE entry before the Honorable Edmond E. Chang: Initial tracking status hearing set for 12/16/2022 at 8:30 a.m. to track the case only (no appearance is required, the case will not be called). Instead, the Court will set the case schedule after reviewing the written status report. The parties must file a joint initial status report with the content described in the attached status report requirements by 12/09/2022. Plaintiff must still file the report even if Defendants have not responded to requests to craft a joint report.
