For the reasons stated in open court, Plaintiff's motion for leave to file an amended complaint #26 is granted. Plaintiff shall file its amended complaint on the docket today, 3/15/23. Defendant's motion to dismiss #17 is denied as moot. Defendant's renewed motion to dismiss is due by 4/5/2023 and shall not exceed 48 pages in length as requested by Defendant. As discussed during the hearing, the Court values concise briefing and encourages the parties to consider edits where possible. Plaintiff may also file an oversize brief in response to Defendant's motion that shall not exceed the length of Defendant's memorandum. Upon filing Defendant's motion to dismiss, the parties shall email the courtroom deputy an agreed-upon proposed briefing schedule. Defendant's motion to stay discovery #22 is denied for the reasons stated on the record. Discovery shall proceed, but the Court will consider a more lengthy discovery period in light of the forthcoming motion to dismiss.
