Plaintiff's Motion for a Temporary Restraining Order #5 is denied. A finding of irreparable harm is a "threshold requirement" for a TRO. See Life Spine, Inc. v. Aegis Spine, Inc., 8 F.4th 531, 545 (7th Cir. 2021) (quoting Foodcomm Intern. v. Barry, 328 F.3d 300, 304 (7th Cir. 2003)). "Harm is irreparable if legal remedies are inadequate to cure it." Id. (cleaned up). Plaintiff Talman Consultants, LLC waited several months to bring its motion, and in that time, Talman Consultants has not suffered "irreparable harm," such as a declaration of bankruptcy or a precipitous drop in revenue. See Garcia v. Google, Inc., 786 F.3d 733, 746 (9th Cir. 2015) (en banc) (reasoning that a five-month delay indicated no "irreparable harm"). Therefore, a legal remedy in the form of damages would likely address any harm to the business. Briefing schedule set as to Motion to Dismiss #15 . Response due by 12/28/2022; Reply due by 1/4/2023.
