MAILED Order #6 dated 12/08/2022 to Thomas V. Ryburn. (rc, ) |
Filing 6 ORDER: The Court denies Plaintiff's application for leave to proceed in forma pauperis #3 . Because Plaintiff has "struck out" under 28 U.S.C. 1915(g), and the allegations do not support a claim of "imminent danger of serious physical harm," he must pay the full statutory filing fee of $402 by January 6, 2023. Failure to do so will result in summary dismissal of this lawsuit. The Court defers initial review of Plaintiff's complaint #1 until receipt of the full statutory filing fee. Plaintiff is also warned that he must disclose the fact that he has accumulated three or more "strikes" under section 1915(g) when filing any new federal lawsuit. Plaintiff's failure to disclose his litigation history, including his "strikes," when he files a new federal lawsuit will result in immediate dismissal of the action with prejudice. The Clerk of Court is directed to send a copy of this order to Plaintiff and to the Court's Fiscal Department. The Court defers ruling on Plaintiff's motion for attorney representation #4 . Signed by the Honorable John Robert Blakey on 12/8/2022: Mailed notice. (rc, ) |
