Filing 9 ANNUAL REMINDER: Pursuant to #Local Rule 3.2 (Notification of Affiliates)#, any nongovernmental party, other than an individual or sole proprietorship, must file a statement identifying all its affiliates known to the party after diligent review or, if the party has identified no affiliates, then a statement reflecting that fact must be filed. An affiliate is defined as follows: any entity or individual owning, directly or indirectly (through ownership of one or more other entities), 5% or more of a party. The statement is to be electronically filed as a PDF in conjunction with entering the affiliates in CM/ECF as prompted. As a reminder to counsel, parties must supplement their statements of affiliates within thirty (30) days of any change in the information previously reported. This minute order is being issued to all counsel of record to remind counsel of their obligation to provide updated information as to additional affiliates if such updating is necessary. Filing 7 MINUTE entry before the Honorable Nancy L. Maldonado: Plaintiff's application to proceed in forma pauperis #3 is granted. The Court has screened Plaintiff's Complaint pursuant to 28 U.S.C. 1915(e)(2) and the complaint is accepted as to Defendant Village of River Grove and John Doe Village of River Grove Police Officer. Plaintiff also purports to name a Harry Smith, Jr. as a defendant, but the Complaint does not include any factual allegations identifying who Smith is, nor does it include any allegations describing how, if at all, Smith was involved in the events that form the basis of Plaintiff's civil rights claims. Plaintiff has thus failed to state any claim against Smith upon which relief can be granted, which warrants dismissal of Smith as a defendant under 28 U.S.C. 1915(e)(2)(B)(iii). The Clerk is directed to accept and file the Complaint, but Harry Smith is dismissed as a defendant without prejudice. Plaintiff may seek leave to amend the complaint to re-add Smith by January 19, 2023. In the meantime, the Clerk is directed to issue a summons for service of the complaint on the Defendant Village of River Grove. The United States Marshals Service is appointed to serve the defendant. The Court notes that Plaintiff appears to have already completed a USM-285 form, but that the form is addressed to Harry Smith and the Village of River Grove. Given that the Court has dismissed Smith as a defendant, Plaintiff must complete and submit a new USM-285 form just for the Village of River Grove. Plaintiff will not be required to pay a fee to the Marshals Service because he maintains IFP status. The Clerk is directed to provide a USM-285 form to Plaintiff with a copy of this order. The Marshals Service will not attempt service on the Village of River Grove unless and until the completed USM-235 is returned. Therefore, Plaintiff must correctly complete a service form and return the form to the Clerk of Court by January 19, 2023. Failure to do so may result in dismissal of this case. The Marshals are authorized to mail a request for waiver of service to the defendant in the manner prescribed by Fed. R. Civ. P. 4(d)(1) before attempting personal service.
