Tharp, Jr:By order dated January 3, 2023, the Court directed Plaintiff to file an amended complaint identifying a theory of relief founded on federal law that could support her claim and to pay the full statutory filing fee of $402. The Court also advised that failure to comply with either of these requirements by January 20, 2023, would result in summary dismissal of the case. #8 As of today's date, Plaintiff has not complied. Accordingly, the Court dismisses this action without prejudice pursuant to Federal Rule of Civil Procedure 41(b). See Fed. Election Comm'n v. Al Salvi for Senate Comm., 205 F.3d 1015, 1018 (7th Cir. 2000) (court has both inherent authority and authority under Rule 41(b) to dismiss case as sanction for failure to prosecute and noncompliance with court order). Tharp, Jr: Upon review of the complaint, it fails to plead subject matter jurisdiction in accordance with Federal Rule Civil Procedure 8(a). It appears to allege a claim for pension/survivor benefits owed to Plaintiff and/or her deceased mother but identifies no theory of relief founded on federal law that could support her claim. The plaintiff is granted leave to amend to address this issue by 01/20/2023. Additionally, the plaintiff's application for leave to proceed in forma pauperis #4 is denied. Plaintiff's application indicates a monthly take-home pay of $3,550; therefore, the plaintiff is not indigent, and deferral of payment of the filing fee is not warranted. Accordingly, by 01/20/2023, the plaintiff is directed to pay the full statutory filing fee of $402.00.
