The parties state they "agree to the dismissal of Counts IV, V, and VI." #13 at 4. The court construes this statement as defendants giving written consent to plaintiff filing an amended complaint omitting those counts pursuant to Fed. R. Civ. P. 15(a)(2). Cf. Taylor v. Brown, 787 F.3d 851, 857 (7th Cir. 2015) ("Rule 41(a) should be limited to dismissal of an entire action."). Defendants' motion to dismiss Counts IV, V, and VI #9 is stricken without prejudice to refiling if plaintiff does not file a second amended complaint omitting those counts. The parties have also filed a stipulation to extend plaintiff's time to respond to defendants' affirmative defenses to February 21, 2023, #14 ; however, the parties should confer on whether any further changes to this schedule will be necessary, since if a second amended complaint is filed, defendants should file an answer to the second amended complaint and affirmative defenses, and then plaintiff may respond to defendants' affirmative defenses. As to the schedule for amended pleadings (any second amended complaint, answer to second amended complaint, and affirmative defenses, and plaintiff's response to defendants' affirmative defenses), that remains part of the referral to Judge Harjani.
