MINUTE entry before the Honorable Jorge L. Alonso: Plaintiff filed his complaint on 12/30/22. Rule 4(m) of the Federal Rules of Civil Procedure states that "[i]f a defendant is not served within 90 days after the complaint is filed, the courton motion or on its own after notice to the plaintiffmust dismiss the action without prejudice against that defendant or order that service be made within a specified time." Today is the 90th day since the complaint was filed and the Defendant has yet to be served. Accordingly, the Court gives notice to Plaintiff that if he fails to serve the Defendant with summons by 4/28/23, the Court will dismiss this case without prejudice pursuant to Rule 4(m).
