March 3, 2023 Filing 4 MOTION by Plaintiff Spencer Jackson for extension of time to amend Habeas Corpus Petition (Lewarchik, David)
January 13, 2023 Opinion or Order Filing 3 ORDER Signed by the Honorable John J. Tharp, Jr on 1/13/2023: Petitioner Spencer Jackson's 28 U.S.C. 2254 habeas petition #1 is taken underadvisement. A preliminary review of his current petition and state criminal proceedings suggests that his petition is time-barred under 28 U.S.C. 2244(d)'s one-year statute of limitations. Additionally, Jackson does not assert a federal claim for 2254 review. But because Jackson did not use or substantially follow a preprinted 2254 form, see LR 81.3; Appendix to RulesGoverning 2254 Cases, the Court may not have all the necessary information on the issues of timeliness and his 2254 claim(s). By March 3, 2023, Jackson must 1) show cause why his action should not be dismissed as untimely and 2) submit an amended petition either on or that substantially follows the form linked above. Failure to timely comply will result in dismissal of the petition. (For further details see order)Mailed notice(air, )
