Filing 3 ORDER regarding #1 Petition for Writ of Habeas Corpus: The Court is in receipt of a 157-page pleading filed by Jerome Johnson, an inmate in Lawrence Correctional Center. The Court has reviewed the legible portions of Mr. Johnsons pleading and cannot determine if the Clerk properly classified it as a habeas petition. The named defendants appear to be members of the medical staff at Lawrence (the director of medical services, the director of registered nurses, and a dental assistant), and the opening paragraph refers to personal injury format. This suggests that Mr. Johnson is attempting to file a civil rights complaint, possibly relating to inadequate medical care at Lawrence. However, other portions of the pleading and the attached exhibits indicate that Mr. Johnson is claiming that his custody is unlawful, indicating that he is attempting to file a habeas petition. The Court needs additional information from Mr. Johnson before it can screen the pleading. Accordingly, the Court DIRECTS Mr. Johnson to file a supplemental pleading stating whether he (1) is bringing claims regarding inadequate medical care at Lawrence or (2) is seeking release from unlawful custody. Mr. Johnson shall file his supplemental pleading on or before October 27, 2022. The supplemental pleading must be legible and should be no longer than three pages in length. See SDIL-LR 5.1(b). Failure to comply with this order will result in dismissal of this case. Signed by Judge David W. Dugan on 10/13/2022. (dsw)THIS TEXT ENTRY IS AN ORDER OF THE COURT. NO FURTHER DOCUMENTATION WILL BE MAILED. [Transferred from Illinois Southern on 1/24/2023.] |
