Gottschall: Plaintiff has been attempting to identify the members of defendant, a limited liability company, and plead defendant's citizenship for diversity jurisdiction, see 28 U.S.C. 1332(a), purposes. Effective December 1, 2022, Federal Rule of Civil Procedure 7.1(a)(2) provides, "In an action in which jurisdiction is based on diversity under 28 U.S.C. 1332(a), a party or intervenor must, unless the court orders otherwise, file a disclosure statement. The statement must nameand identify the citizenship ofevery individual or entity whose citizenship is attributed to that party or intervenor... when any later event occurs that could affect the court's jurisdiction under 1332(a)." Fed. R. Civ. P. 7.1(a)(2)(B) (2022) (internal numbering omitted). Because defendant's citizenship is at issue, defendant is directed to file the disclosure statement required by Rule 7.1(a)(2) on or before March 30, 2023. Mailed notice (vcf, )

Gottschall: To establish defendant's citizenship for diversity jurisdiction purposes, see 28 U.S.C. 1332(a), plaintiff alleges in its amended complaint: "Berlin is a limited liability company organized under the laws of Delaware, and, according to Berlin, its principal place of business is at 525 West Monroe Street, 14th Floor, Chicago, Illinois 60661. Berlin has identified five of its affiliates (see R. Doc. 17), which on information and belief are members of Berlin or members of its members, including one that is listed as 'manager' on the records of the Illinois Secretary of State. That entity is Berlin Packaging Holdings, LLC, a Delaware limited liability company. After a diligent search and based on information and belief, each of the identified members appears to be organized under the laws of Delaware and are either citizens of Delaware or Illinois for purposes of diversity jurisdiction. On information and belief, none of the affiliates or members of Berlin are citizens of the state of Louisiana. Berlin is therefore a citizen of Delaware and Illinois for diversity purposes." ECF No. 30 at 2-3. These allegations are defective because, under Seventh Circuit law, allegations of a party's citizenship made on information and belief do not suffice to establish diversity jurisdiction. America's Best Inns, Inc. v. Best Inns of Abilene, L.P., 980 F.2d 1072, 1074 (7th Cir. 1992); see also Qin v. Deslongchamps, 31 F.4th 576, 578 (7th Cir. 2022); Brickstructures, Inc. v. Coaster Dynamix, Inc., 2017 WL 4310671, at *1 (N.D. Ill. Sept. 28, 2017). Plaintiff's amended complaint #30 is therefore dismissed without prejudice for failure to plead an adequate basis for exercising subject matter jurisdiction. In accordance with 28 U.S.C. 1653, plaintiff is granted leave to file an amended complaint on or before 4/3/2023. Failure adequately to allege a basis for exercising subject matter jurisdiction will result in the dismissal of this case without prejudice for lack of subject matter jurisdiction.
