ORDER: The plaintiff's application for leave to proceed without prepaying fees #3 is denied without prejudice. Plaintiff's application represents that he is both currently employed (Question 1) and unemployed (Q.8). These inconsistent statements require clarification. The plaintiff should also clarify the response regarding his other assets (Q.5). The response suggests that the plaintiff owns real estate worth $150,000 but does not reveal whether that is the value of his equity in the home or the value of the property. Additionally, the application is incomplete. The plaintiff does not indicate the amount of his monthly take-home pay (Q.1), whether he is married, and if so, the employment status of his spouse (Q.2), and whether he or his spouse have dependents (Q.6). Accordingly, by 02/15/2023, the plaintiff is directed to either pay the full statutory filing fee of $402.00 or file a second application to proceed without prepaying fees that corrects the identified inconsistencies and supplies all required information.
