Chang: On review of the amended status report, R. 11, the Defendant intends to move to dismiss based on the prior settlement agreement (and apparently the additional tender of funds). The motion would not properly be a Rule 12(b)(6) motion, but instead an early summary judgment motion. So some limited discovery, or an agreement on a set of facts, would be needed. The parties also request a settlement conference. The case is referred to the magistrate judge for discovery supervision and a settlement conference. The Court will review whatever is filed on the responsive pleading deadline of 04/03/2023 and go from there, but hopefully the parties will agree to pause the litigation to devote time to settlement efforts instead.
