Filing 4 MINUTE entry before the Honorable Martha M. Pacold: Plaintiff is ordered to show cause by 2/24/2023 why this case should not be dismissed for lack of subject matter jurisdiction. The complaint #1 states that the court has jurisdiction over the action pursuant to federal question jurisdiction, 28 U.S.C. 1331, and supplemental jurisdiction, 28 U.S.C. 1367(a). However, plaintiff asserts claims under only Illinois and Florida state law. Plaintiff must therefore demonstrate that the court has jurisdiction pursuant to the diversity jurisdiction statute, 28 U.S.C. 1332(a). Accordingly, plaintiff must allege that the "matter in controversy exceeds the sum or value of $75,000, exclusive of interest and costs, and is between-(1) citizens of different States." Id. "For diversity jurisdiction purposes, the citizenship of an LLC is the citizenship of each of its members." Thomas v. Guardsmark, LLC, 487 F.3d 531, 534 (7th Cir. 2007). Plaintiff may discharge this order by filing a jurisdictional statement by 2/24/2023 that properly establishes the amount in controversy and the diversity of citizenship between the plaintiff and the defendants. Failure to comply will result in dismissal for lack of subject matter jurisdiction. (rao, ) |
