Filing 258 MINUTE entry before the Honorable Mary M. Rowland: Status hearing held on October 2, 2023. The parties discussed discovery matters. The Court addressed nine categories of discovery disputes common to most or all defendants. (1) First, as to defendants' affiliated entities: as the law is settled that a defendant need not have actual possession of documents to be in control of those documents, Defendants must produce relevant documents of affiliates if defendants have control over that affiliate. By 10/10/23, each Defendant is to identify (a) the affiliates that defendant has control over for purposes of discovery production and (b) the affiliates that are not being searched, along with an explanation for why those entities do not have documents within that defendant's "possession, custody or control". (2) Next, regarding outside-of-the-U.S. (OUS) documents, by 10/10/23 Defendants are to provide Plaintiffs a list of document requests that Defendants will respond to and those for which they will stand on their objection(s). (3) Parties discussed their views on the definition of "hair relaxer products." As to hair relaxer kits sold to consumers, parties agree that it is limited to the kits and does NOT include the conditioners or shampoos that may be recommended "for best results" on the back of the kit. But the discovery will include ALL the products contained in the kit. As for hair relaxer products sold commercially to salons, the parties will meet and confer. Production will be limited to the products required by the label, not all products sold by the Defendant to the salon per Defendants' suggestion. (4) As to temporal scope, Defendants generally do not object to Plaintiffs requesting documents dating back five years from when a defendant began manufacturing, selling and/or marketing the product; however, if there are any particular categories of documents Defendants object to producing based on this time period, they should so specify in their discovery responses. (5) The Court denied Plaintiffs' request for (and sustained Defendants' objection to) production of Defendants' litigation hold letters or the parameters of those litigation hold letters. (6) Defendants are reminded of their obligation to comply with FRCP 33(d) in responding to interrogatories. (7) With regard to patents and patent-related documents, the Court overrules Defendants' objection. Defendants must produce relevant and responsive patent and patent-related documents. The case, Intercat, Inc. v. Nol-Tec Sys., a Minnesota district court case, was cited to the Court. The Court reviewed that case, a patent case specifically noting a company's "interest in preventing a competitor from acquiring confidential intellectual property" (and still granted the motion to compel there). The Court is not persuaded that case requires sustaining Defendants' objection here. (8) The deadline for Defendants to produce all responsive documents is November 13, 2023 (except for defendants Sally Beauty, Luster Products, and McBride, who will meet and confer with Plaintiffs). Defendants are to file a status report updating the Court about written discovery production by 11/13/23. (9) Finally, Plaintiffs must serve narrowly tailored written requests regarding ESI on Defendants by 10/5/23; Defendants shall respond by 10/19/23. No 30(b)(6) deposition will be taken until the written discovery is complete and the Court will address this issue if needed at the November hearing. As to defense counsel, the Court ordered Defendants to file a notice updating the Court about Defendants' lead and/or liaison counsel by 10/6/23. Filing 206 MINUTE entry before the Honorable Mary M. Rowland: Status hearing held on August 23, 2023. The parties addressed the matters set forth in the Joint Status Report #187 . First, as to pleadings, the Court set a deadline of 8/30/23 for a joint written status report to be filed addressing defendant McBride as it relates to its motion to dismiss #192 and the omnibus motion to dismiss. Plaintiffs' counsel informed the Court that a revised short form complaint (SFC) may need to be submitted in the future to account for, for example, the substitution regarding defendant Sally Beauty. As to defendant Dermoviva Skin Essentials Inc., on 8/4/23, Plaintiffs filed a stipulation of voluntary dismissal without prejudice of all claims against Dermoviva (Dkt. 177) and the Court entered that stipulated dismissal (Dkts. 182, 183). The parties shall file a joint status report by 8/29/23 to clarify the status of Dermoviva. Second, as to discovery, parties are meeting and conferring about Rule 26(a)(1) disclosures and other discovery matters. The parties raised several issues regarding 30(b)(6) depositions and ESI discovery, particularly as to pertains to defendants Beauty Bell, Revlon, and Namaste. The Court set a status hearing date of October 2, 2023 at 2:00pm CST that will focus solely on discovery issues. Only counsel involved in those issues need to attend on October 2. The hearing is in person but for those wishing to appear by video, the Court's chambers will send a WebEx link 3 business days in advance to Plaintiffs' and Defendants' Liaison counsel. Liaison counsel should distribute the link accordingly. If anyone appearing via WebEx wishes to be heard at the hearing, they should notify their respective liaison counsel at least 2 business days in advance and liaison counsel should then notify the Courtroom Deputy. Individuals may also listen via teleconference and should mute themselves upon calling in: the number is 6504793207 and the ID is 1801732451. On or before 9/27/23, parties shall file separate but simultaneous submissions summarizing the current discovery disputes. Third, bankruptcy counsel apprised the Court of the Revlon bankruptcy status as well as subject matter jurisdiction as it relates to cases against Revlon. If counsel believe in the future that a separate joint status report on the Revlon bankruptcy would be helpful to the Court, they are free to file that. Revlon's motion for extension of time to respond to certain interrogatories #188 is granted in part. Revlon has until 8/31/23 to respond to Interrogatory No. 4. The court otherwise grants Revlon until September 20, 2023 to respond. Finally, the Court informed the parties that FAQ were posted on the Court's MDL webpage (https://www.ilnd.uscourts.gov/MDL3060). If any final updates or changes are needed to those, parties should jointly submit suggested changes by 8/31/23, to the Court's proposed order box only (Proposed_Order_Rowland@ilnd.uscourts.gov). Rowland: The Court's July 6th Minute Order [ECF 146] required the parties to "meet and confer and by 7/18/23, file on the docket, and submit to the Court's proposed order box, proposed fact discovery dates and a fact discovery close date." On 7/18/23, Liaison Counsel for Plaintiffs emailed the courtroom deputy, with a CC to opposing counsel, informing the Court that the parties were at an impasse regarding how they interpreted that portion of the court's July 6th order and jointly requested an extension to submit the Discovery Case Management Order (CMO). To clarify, the parties were to file on the docket by 7/18/23, the proposed schedule. However the parties have agreed to postpone the deadline in light of other pressing matters. [See 161]. Therefore the Court extends the deadline for the Discovery CMO. The deadline is now 7/26/23. First, as to pleadings, the schedule previously set by the Court remains: Plaintiffs' response to the omnibus motion to dismiss is due 8/4/23. Defendants' reply is due 8/25/23. As discussed at the hearing, as to Defendant Parfums de Coeur's motion to dismiss #134 , Plaintiffs' response is due 8/4/23; Defendant's reply is due 8/25/23. Defendant McBride's #145 motion for extension is granted and McBride has until 8/21/23 to file its responsive pleading. Plaintiffs' status report regarding McBride should be filed by 7/14/23. Plaintiffs' consolidated class action complaint will be filed by 7/31/23. As to the proposed short form complaint (SFC) and the issue of identifying products, the parties shall meet and confer on this by 8/4/23. In light of the discussion and circumventing the meet and confer process, the court finds that each defendant is free to preserve its objections to the Plaintiffs' outstanding interrogatory asking for the identity of hair straightening products and the definition plaintiffs include regarding same, however, after asserting all objections, each defendant must identify said products in response to the interrogatory. Second, the parties reported on the Revlon bankruptcy in the Southern District of New York. The Court heard argument regarding the September 14, 2023 MDL filing deadline as set by the bankruptcy court in April 2023 (BK Doc. 1860). This Court will issue a separate order addressing plaintiffs' request to this Court to extend the September 14, 2023 filing deadline. Third, regarding discovery, initial disclosures will be served 8/7/23. The Court heard argument and each party's view about how discovery should proceed. The Court declines to adopt Defendants' proposal (Dkt. 125 at 6) requesting prioritizing "general causation" discovery. Parties are to proceed with "traditional" fact discovery, and should meet and confer and by 7/18/23, file on the docket, and submit to the Court's proposed order box, proposed fact discovery dates and a fact discovery close date. Defendants are free to raise their proposal to prioritize general causation discovery again with the Court at the close of fact discovery. Parties are also to meet and confer about fact sheets. The Court will conduct a Science Day near the close of fact discovery. Parties should be prepared to discuss it at the 11/17/23 hearing. Finally, by 7/31/23, parties should file a status report outlining suggested FAQ's for the Court's MDL webpage (https://www.ilnd.uscourts.gov/MDL3060). Filing 114 MINUTE entry before the Honorable Mary M. Rowland: Status hearing held on May 31, 2023. The parties addressed the matters set forth in their May 26 Joint Status Report #113 . The Court set the following deadlines. First, as to pleadings, Defendants shall file their omnibus motion to dismiss the Master Long Form Complaint on or before 7/6/23; the motion shall be no more than 35 pages. Plaintiffs' response, of no more than 35 pages, is due 8/4/23. Defendants' reply, of no more than 20 pages, is due 8/25/23. As to the short form complaint (SFC), at this stage, Plaintiffs should continue to file pursuant to the Direct Filing Order (CMO 2). Plaintiffs should not use the SFC yet. Plaintiffs will file their consolidated class action complaint by 6/15/23. Second, as previously ordered, the parties will file simultaneous briefs of no more than 20 double spaced pages addressing general causation by 6/5/23. Third, the parties presented their positions on initial disclosures. The status conference set for 7/6/23 constitutes the Rule 26(f) conference. Dates for parties to meet and confer about initial disclosures and to exchange initial disclosures pursuant to FRCP 26(a)(1) flow from that date pursuant to the Rules. Fourth, as to federal/state coordination, given the low number of state court proceedings at this time, the Court will require Defendants to report every 3 months at a status hearing on the number and geographic areas of those proceedings (the Court requests Defendants to report on this issue at the 10/4/23 status hearing). Finally, two additional matters the parties should confer and be prepared to discuss at the 7/6/23 status hearing are a potential Science Day and suggested FAQ's for the Court's MDL webpage (https://www.ilnd.uscourts.gov/MDL3060). For the next status hearing on 7/6/23 at 1:00pm CST: for those wishing to appear by video, the Court's chambers will send a WebEx link 3 business days in advance to Plaintiffs' and Defendants' Liaison counsel. As to the privilege log issue, the Court ruled that the following language shall be included in paragraph 14 addressing what need not be logged: For work product: "Privilege log identification is not required for work product authored by in-house counsel after October 21, 2022." The Court set the following deadlines. First, as to pleadings, on or before 5/15/23, Plaintiffs shall file the master complaint along with a short form complaint. (In addition, Plaintiffs' counsel reported that Plaintiffs anticipate that the "New Revlon" will be named in the new complaint). On or before 6/15/23, Plaintiffs shall file their class complaint. If Plaintiffs are not prepared to file the class complaint by that date, they shall file a status report by 6/15/23 updating the Court on the status of that complaint and whether Court intervention is needed. Second, as to general causation, the Court orders that 21 calendar days after Plaintiffs file the master non-class complaint, parties shall file simultaneous briefs of no more than 20 double spaced pages addressing general causation. The Court will rule thereafter by mail or orally at a scheduled status hearing. Third, on or before 5/2/23, parties will submit to the Court's proposed order box an agreed (potentially combined) proposed order or orders addressing: preservation, ESI, confidentiality, claw-back, and privilege log. If there are any remaining disputes on any of those issues, parties should file a joint status report by 5/2/23 setting forth the particular disputes and the parties' positions. After reviewing the report, the Court will either schedule a virtual hearing with the relevant counsel for each party or the Court will address the dispute at the next scheduled hearing. Fourth, the parties provided their positions on initial disclosures. The Court did not set deadlines yet for initial disclosures, pending the filing of Plaintiffs' master complaint. Fifth, as requested at the hearing, the Court will enter the agreed Qualified Protective Order with the 'Case Management Order No. 3' heading (the Order will retain the originally-filed 4/17/23 date). The court finds, pursuant to LR 40.4(a) that Perez's case involves the same issues of face and law as the matter at issue in the MDL: questions of law and fact arising from Defendants' manufacture, marketing and sale of hair care products containing EDC's, exposure to which it is alleged can cause disruption of the endocrine system and cancers. The factors required by LR 40.4(b) are also satisfied since both cases are pending in the Northern District of Illinois, transferring Perez's matter will save judicial resources and the MDL is at the early stages.
