Filing 4 ENTERED JUDGMENT on 2/16/2023. Mailed notice (cn). |
Filing 3 MINUTE entry before the Honorable Robert W. Gettleman:Plaintiffs David Guggenheim and Lana Johnson have brought a five count pro se complaint against defendants Lawton D. Offei and Kenyatta Offei alleging fraud and breach of contract. Federal jurisdiction is purportedly based on 28 U.S.C. 1332. Section 1332 requires complete diversity between the parties, which means that "none of the parties on either side of the litigation may be a citizen of the state of which a party on the other side is a citizen." Howell by Goerdt v. Trib. Ent. Co., 106 F.3d 215, 217 (7th Cir. 1997) (citations omitted). The instant complaint indicates that both plaintiffs and defendant Lawton Offei are citizens of Illinois, demonstrating that complete diversity is lacking. Consequently, the complaint is dismissed without prejudice for lack of subject matter jurisdiction. Civil case terminated. Mailed notice (cn). |
