Filing 20 STATUS Report (Jurisdictional) by Total Airport Services, LLC (Byrnes, T.) |
Filing 19 MINUTE entry before the Honorable M. David Weisman: Magistrate Status hearing held. As an initial matter, the Court noted that defendant needs to supplement the record as to jurisdiction. Henderson ex rel. Henderson v. Shinseki, 562 U.S. 428, 434 (2011) ("[F]ederal courts have an independent obligation to ensure that they do not exceed the scope of their jurisdiction, and therefore they must raise and decide jurisdictional questions that the parties either overlook or elect not to press."). Here, defendant Total Airport Services, LLC must advise the Court of all members of the LLC and their respective states of citizenship to confirm diversity jurisdiction. Wise v. Wachovia Sec., LLC, 450 F.3d 265, 267 (7th Cir. 2006) ("The citizenship for diversity purposes of a limited liability company... is the citizenship of each of its members."). Defendant may either amend the Notification of Affiliates at ECF 10 or file a separate jurisdictional status report with the necessary information. Defendant must make the appropriate jurisdictional filing by 4/28/23. As to discovery, the Court adopted the following dates from the parties' joint status report #15 : Rule 26(a)(1) disclosures to be made by 5/4/23; fact discovery to close on 12/8/23. Additionally, the parties must issue written discovery requests by 5/19/23. After 5/19/23, the parties may only issue additional written discovery by agreement of the parties or by obtaining leave of court. Status hearing scheduled for 7/11/23 at 9:15 a.m. Joint status report to be filed by 7/7/23, addressing: the status of written discovery (including anticipated motion practice); a proposed number and listing of depositions; and whether the parties are interested in a settlement conference (either at present or potentially after certain discovery is completed). To the extent a protective order is needed, the parties are directed to file a motion for protective order by 5/4/23. Mailed notice (ao, ) |
Filing 18 MINUTE entry before the Honorable M. David Weisman: This case has been referred to Magistrate Judge Weisman for the purposes of discovery supervision, including setting all deadlines, and settlement conference. Initial status hearing scheduled for 4/19/23 at 9:15 a.m. Prior to the status hearing, the Court specifically requests that counsel consult the Court's standing order. If the parties believe the case is ready for a settlement conference, counsel should have available dates for a settlement conference for all necessary parties in advance of the status hearing, and to the extent possible, consult with opposing counsel in an attempt to identify mutually convenient and feasible dates for the settlement conference. Judge Weisman generally conducts settlement conferences Tuesdays, Wednesdays, Thursdays, and Fridays at either 10:30 a.m. to 12:30 p.m. or 2:00 p.m. to 4:00 p.m. Other dates and times may be available as required by the Court or the parties.
