Filing 10 MINUTE entry before the Honorable Mary M. Rowland: On 2/27/23, the Court ordered Plaintiff to file a jurisdictional supplement by 3/20/23 to cure its deficient jurisdictional allegations. #8 . Plaintiff did not file the jurisdictional supplement as directed and thus failed to comply with the Court's order. To allow one last opportunity to cure its jurisdictional statement, by 4/3/23, Plaintiff must show cause why this case should not be dismissed for lack of subject matter jurisdiction. Failure to show cause will result in dismissal of this case. Mailed notice. (dm, ) |
Filing 9 MINUTE entry before the Honorable Mary M. Rowland: On or before 5/10/23, the parties shall file a joint initial status report. A template for the Initial Status Report, setting forth the information required, may be found at http://www.ilnd.uscourts.gov/Judges.aspx by clicking on Judge Rowland's name and then again on the link entitled 'Initial Status Conference.' (dm, ) |
Filing 8 MINUTE entry before the Honorable Mary M. Rowland: In light of Plaintiff's invocation of diversity as the basis for federal jurisdiction #1 , on or before 3/20/23, Plaintiff shall file a jurisdictional supplement, as a separate docket entry. Plaintiff is reminded that "there's no such thing as a [state name here] partnership or LLC, that only the partners' or members' citizenships matter, and that their identities and citizenships must be revealed." West v. Louisville Gas & Elec. Co., 951 F.3d 827, 829 (7th Cir. 2020). Thus, for the Defendant LLC, Plaintiff "must identify the citizenship of each of its members as of the date the complaint or notice of removal was filed, and, if those members have members, the citizenship of those members as well." Thomas v. Guardsmark, LLC, 487 F.3d 531, 534 (7th Cir. 2007). Plaintiff is also reminded that for individuals, citizenship means domicile (the person's long-term plan for a state of habitation) rather than current residence. Dancel v. Groupon, Inc., 949 F.3d 999, 1003 (7th Cir. 2019). Finally, Plaintiff is advised that allegations "upon information and belief" are insufficient. HCP III Arlington TS LLC v. Grupo Cinemex, S.A. de C.V., 534 F. Supp. 3d 921, 923 (N.D. Ill. 2021). Failure to file the jurisdictional supplement as directed may result in dismissal of this case for lack of jurisdiction. Mailed notice. (dm, ) |
