Filing 14 ORDER: The Court denies Plaintiff Fodie McBride's emergency motion to stay approved foreclosure sale #6 . McBride's motion amounts to a request that the court stay proceedings in his state court foreclosure action. But such relief, and any other injunctive relief implicating the related state court proceedings, is barred by the Anti-Injunction Act. The Anti-Injunction Act prohibits a federal court from granting an injunction to stay proceedings in a state court "except as expressly authorized by Act of Congress, or where necessary in aid of its jurisdiction, or to protect or effectuate its judgments." 28 U.S.C. 2283. None of the exceptions apply here. Congress has not expressly authorized the requested injunction and no unique federal right exists here that will be frustrated if not enjoined. The "necessary in aid of jurisdiction" exception applies typically to in rem actions, but the Court does not have in rem jurisdiction over the property at issue. See Winkler v. Eli Lilly & Co., 101 F.3d 1196, 1202 (7th Cir. 1996) ("Ordinarily, the 'aid of jurisdiction' exception to the Anti-Injunction Act applies only to parallel state in rem rather than in personam actions."). Moreover, even if this were an in rem case, this Court could not enjoin the state court proceeding because the state court obtained custody of the res first. Catuara v. Heavner Handegan Scott & Beyers, No. 03 C 563, 2003 U.S. Dist. LEXIS 8027, at *6 (N.D.Ill. May 8, 2003). The relitigation exception does not apply because that exception applies only to matters that have already been adjudicated. Id. at *7. Here, there has been no final adjudication or judgment in this case that needs to be protected or effectuated. Thus, the Anti-Injunction Act bars McBride's request for injunctive relief. The Court denies Plaintiff's motion for attorney representation #4 without prejudice. Plaintiff has not filed a financial affidavit demonstrating that he cannot afford an attorney. The Clerk is directed to seal document #6 . The initial status conference in this matter is set for 5/9/2023 at 9:30 a.m. The parties are directed to review the procedures and requirements for this conference on Judge Ellis' website and to submit the required Initial Status Report by 5/2/2023.
