Filing 7 MINUTE entry before the Honorable Lindsay C. Jenkins: In an order dated 03/16/2023, the Court ordered Plaintiff, who was then-incarcerated, to resolve his fee status by 04/07/2023, by submitting an in forma pauperis application or paying the full $402 filing fee associated with this lawsuit #3 . The Court warned him that failure to comply would result in summary dismissal of this case. [Id.] Subsequently, Plaintiff's mail (the Court's 03/16/2023 order) was returned as undeliverable and re-sent to Plaintiff at a residential address in Crest Hill, IL. #6 If Plaintiff wishes to proceed further with lawsuit, he must resolve his fee status in accordance with the Court's 03/16/2023 order. On its own motion, the Court extends Plaintiff's time for doing so until 05/05/2023. The Court notes that since Plaintiff appears to have been released since the filing of this case, he must also include information about how he is currently supporting himself -- i.e., new employment, public assistance, family, etc. -- in any in forma pauperis application that he submits to this Court. If Plaintiff fails to comply with this order by 05/05/2023, the Court will summarily dismiss this case. Plaintiff is advised that he has a continuing obligation to keep the Court apprised of his current address, and failure to do so may result in dismissal of this lawsuit for failure to comply with a Court order and for want of prosecution. Filing 3 MINUTE entry before the Honorable Lindsay C. Jenkins: Plaintiff Victor V. Bailey, an inmate at the Will County Adult Detention Facility, initiated this civil rights lawsuit without paying the Court's filing fee or applying for leave to proceed in forma pauperis (IFP). The Prison Litigation Reform Act (PLRA) requires that all prisoners seeking to bring a federal civil action or appeal pay the full filing fee. See 28 U.S.C. 1915(b). A prisoner may pay the fee in full in advance or, if qualified to proceed IFP, make installment payments deducted directly from his custodial trust fund account. If Plaintiff wishes to proceed further with this lawsuit, he has until April 7, 2023, to either (1) file a properly completed and supported application to proceed IFP on the enclosed form, or (2) prepay the $402 filing fee. Failure to comply with this order by this date will result in summary dismissal of this case. The Clerk of Court is directed to send Plaintiff a blank application to proceed IFP and a copy of this order. The Clerk is further instructed to correct the docket to reflect Plaintiff's address as "Will County Adult Detention Facility" (rather than "Will County Facility"). Mailed notice. (jlj, ) |
