ORDER : Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders Plaintiff (and his trust fund officer) to pay $24.83 as an initial partial filing fee. The Court further directs Plaintiff's trust fund officer to begin making monthly deductions from Plaintiff's account toward payment of the filing fee in accordance with this order. The Court directs the Clerk of Court to: (1) send a copy of this order (electronically, if possible) to Plaintiff's trust fund officer and to the Court's Fiscal Department; (2) file the complaint; (3) issue summonses for service of the complaint on Defendants McCray, Dr. Kingson, Dr. Masi, Franzo, Peterson, Reyes, Cooper, Hersch, Spann, and Hendrix by the U.S. Marshal; (4) dismiss all other Defendants; and (5) send Plaintiff ten blank USM-285 (Marshals service) forms and a copy of this order. The Court appoints the U.S. Marshal to serve Defendants.Plaintiff must complete and return a USM-285 form for service for each Defendant. Failure to return the USM-285 may result in dismissal of any unserved Defendant as well as dismissal of this case in its entirety. Plaintiff must promptly submit a change-of-address notification if he is transferred to another facility or released. If Plaintiff fails to keep the Court informed of his address, this action will be subject to dismissal for failure to comply with a Court order and for failure to prosecute. Plaintiff's motion for attorney representation #4 is granted. The Court requests that Justin Kalani Beyer of Seyfarth Shaw LLP, 233 South Wacker Drive, Suite 8000 Chicago, Illinois, 60606, represent Plaintiff in this case in accordance with counsel's trial bar obligations under the District Court's Local Rules 83.11 and 83.37 (N.D. Ill.).Counsel is directed to file an appearance in this case by March 24, 2023. Counsel shall also file a status report with the Court by April 14, 2023, addressing whether he has been able to confer with Plaintiff and the status of whether he is going to proceed with the present complaint or will be submitting an amended complaint. A copy of this order shall also be sent to the PACER Service Center at https://pacer.uscourts.gov/, to the Systems Department of the Northern District of Illinois, to Plaintiff, and to Plaintiff's counsel.
