Chang: On review of the status report, R. 8, and the Defendant's extension motion #9 to respond to the complaint, the response to the complaint was due on 04/13/2023. The extension motion asserts for excusable neglect, Fed. R. Civ. P. 6(b)(1)(B), that defense "merits counsel is not licensed to practice in this jurisdiction at this time." R. 9 at 2. The Court has no objection in principle to an extension so early in the case, and does not want to make a mountain out of a molehill, but this particular explanation does not seem to amount to excusable neglect. In federal court, counsel may practice in this District after filing for pro hac vice admission. The extension motion does not identify the "merits" counsel and why it has taken almost three weeks to file a simple pro hac vice motion. Or maybe counsel plans to move for admission into the General Bar of this District, but that too is not explained. Maybe there is case law that equates this to excusable neglect, but no case is cited. The Defendant shall supplement the extension motion with further explanation on 05/01/2023. Excusable neglect is not hard to meet at all (see Pioneer Inv. Servs. Co. v. Brunswick Assocs. Ltd. Pship., 507 U.S. 380, 394-95 (1993)), so if a real reason is momentary carelessness, then just say so. Again, the last thing intended is to unnecessarily expand this motion, but this barebones explanation is not enough. If the Plaintiff really feels the need to reply, the Plaintiff may do so on 05/04/2023. The defense should be preparing to respond to the complaint on 05/08/2023 as requested.
