| TEXT ORDER entered by U.S. District Judge Sue E. Myerscough on 4/12/2023: Plaintiff has filed in this Court a Complaint alleging a violation of the Administrative Procedure Act, 5 U.S.C. 551 et seq. See Compl., d/e #1 . This Court, however, is an improper venue for Plaintiff's claims. An action brought against "an agency of the United States" may be filed "in any judicial district in which (A) a defendant in the action resides, (B) a substantial part of the events or omissions giving rise to the claim occurred, or a substantial part of property that is the subject of the action is situated, or (C) the plaintiff resides if no real property is involved in the action." 28 U.S.C. 1391(e)(1). From the face of the Complaint, Plaintiffs cause of action arises out of Naperville, Illinois, which is located within the Eastern Division of the Northern District of Illinois. Therefore, pursuant to 28 U.S.C. 1404(a), the Clerk is DIRECTED to transfer this case to the U.S. District Court for the Northern District of Illinois, Eastern Division.(HS) [Transferred from Illinois Central on 4/14/2023.] |
