For the reasons stated on the record, the Plaintiff's motion for TRO #8 is denied. If the Plaintiff plans on filing a motion for preliminary injunction for pre-judgment asset restraint, then the Plaintiff shall explain (a) whether the physical addresses of the Seller-Defendants are bona fide addresses; and (b) whether the Plaintiff would have access to judgment-collection methods in China. Temu shall respond to discovery requests on the amount of funds held by Temu as to particular Seller-Defendants within three business days of each request. (2.) Temu's response to the first amended complaint is due 06/29/2023. (3.) The Plaintiff shall review the opinion in Estee Lauder Cosmetics Ltd. v. Schedule A, Case No. 19-cv-7878, 2020 WL 433870 (N.D. Ill. Jan. 27, 2020), and file a supplemental memorandum addressing the propriety of joinder by 06/20/2023. A tracking status hearing is set for 07/14/2023 at 8:30 a.m., to track the case only (no appearance is required, the case will not be called). As discussed during the hearing, WhaleCo shall be allowed a chance to respond in writing. First, the Plaintiff shall file a comprehensive supplemental memorandum, by 05/15/2023, with all of its newly discovered evidence of allegedly infringing listings. But the Plaintiff shall promptly and continuously provide WhaleCo with the listings as they are discovered in a cooperative effort. The Defendants shall respond by 05/22/2023. The Plaintiff's reply, if any, is due 05/26/2023. On expedited discovery, by 2:00 p.m. Central on 05/12/2023, WhaleCo shall provide the Plaintiff's counsel with the seller-account information for Defendant Romantic Room Y, specifically (a) records showing the opening of the seller account and the profile information for the seller (including all address and contact information); and (b) records reflecting any transactions in the targeted listing (now taken down) of the allegedly infringing towels, including date and, payment information for those transactions. If the parties are unable to agree on a confidentiality order before the disclosure, then the disclosure shall be attorneys'-eyes only until a confidentiality order is in place.
