Filing 8 MINUTE entry before the Honorable Nancy L. Maldonado:The Court has reviewed Plaintiff Martell M. Box's motion for status and update #7 , which states that since 5/15/23, Menard Correctional Center has been on lockdown for security reasons. The lockdown has hindered Plaintiff's ability to attend law library services, so Plaintiff requests that the Clerk of Court mail out the summons and ensure that Defendants are served. The motion for status #7 is granted to the extent that the Court provides the following update: in light of Plaintiff's incarceration and the need for the Court to screen his Complaint pursuant to 28 U.S.C. 1915A, the deadline to complete service is stayed. The Court will first issue an order screening the Complaint and will then provide further instructions regarding service. At this time no further action is needed from Plaintiff except to update his address if it changes. (ca, ) |

Service must be performed by an individual over 18 years old who is not a party to this case. Plaintiff has 90 days from 5/23/23, the date his Complaint was filed, to complete service, unless Plaintiff shows good cause for an extension. Fed. R. Civ. P. 4(m). Plaintiff may also visit the Court's website, www.ilnd.uscourts.gov, for information for pro se litigants (see "Information for People without Lawyers (Pro Se)"). Filing 3 ORDER: Plaintiff, a prisoner currently at Menard Correctional Center, filed this pro se civil rights lawsuit in connection with certain disciplinary action that was taken against him while he was incarcerated at Dixon Correctional Center. Plaintiff did not pay the filing fee or seek permission to proceed in forma pauperis. If Plaintiff wishes to proceed further with this matter, he must resolve his fee status by either filing an application to proceed in forma pauperis or paying the full $402 filing fee. Failure to comply with this order by June 12, 2023, will result in summary dismissal of this case. The Clerk of Court is directed to send Plaintiff a blank application to proceed in forma pauperis and a copy of this order. Plaintiff also must promptly submit a change-of-address notification if he is transferred to another facility or released. If Plaintiff fails to keep the Court informed of his address, this action will be subject to dismissal for failure to comply with a Court order and for failure to prosecute. The Court defers consideration of Plaintiff's Complaint #1 until Plaintiff resolves his fee status. Signed by the Honorable Nancy L. Maldonado on 5/8/2023. Mailed notice (jh, ) |
