There is no good cause for proceeding with Plaintiff's motion for preliminary injunction---which will most likely require an evidentiary hearing---half-cocked. Expedited discovery will allow the parties to be better prepared and to identify the material disputes and issues for the court's consideration. Besides, this discovery needs to happen eventually. The more meaningful issue is the scope of such discovery in advance of fully briefing the motion for preliminary injunction and the hearing. Both sides are to file, by July 7, 2023, a motion for leave to serve limited discovery on an expedited basis including the proposed interrogatories (maximum of five), document requests (five), and Rule 30(b)(6) topics (five) to be served on the opposing side. Parties are to explain the relevance of such proposed discovery. The court will address any need for requests to admit after this first round of discovery. Each side then has until July 14, 2023, to pose objections, if any, to the proposed discovery. A hearing on the motions is scheduled for July 19, 2023, at 1:00 p.m. in courtroom 1019. The attorney who will be addressing the court on the motion must be present in person. The court is not inclined to change the schedule entered here or the hearing date. Finally, the parties are to confer on the need for a confidentiality order and file either an agreed motion or a contested motion for the entry of such order by July 14, 2023.
