Filing 10 ORDER On April 25, 2023, Plaintiff Kenyatta D. Adams filed a complaint in the Circuit Court of DuPage County, Illinois, seeking review of a Social Security Administration (SSA) decision. (Dkt. 2 1; id. at 7.) On May 22, 2023, Defendants removed the suit to federal district court pursuant to 28 U.S.C. 1442. (Dkt. 2 2.) Four days later, Defendants filed a motion to dismiss. (Dkt. 5.)Defendants argue for dismissal based on the doctrine of derivative jurisdiction. (Dkt. 5 34.) In other words, they argue that because federal courts have exclusive jurisdiction over SSA appeals, the state court did not have jurisdiction over Adams' suit, and when such a case is removed to federal court, the federal court also lacks jurisdictioneven if it would have had jurisdiction if the plaintiff had originally filed suit in federal court.
