Gettleman on 6/12/2023: In this single instance, the Court grants Plaintiff's application for leave to proceed in forma pauperis #3 and waives the filing fee. Plaintiff should, however, carefully review the information in this order about civil detainee filing fee obligations as if he initiates another lawsuit, he may be required to pay a full or partial filing fee even though he is not subject to the Prison Litigation Reform Act. The Court dismisses Plaintiff's complaint #1 because it fails to state a claim upon which relief may be granted and is legally frivolous. The dismissal is without prejudice to Plaintiff's ability to pursue other relief concerning his commitment or another federal civil rights lawsuit if and when his commitment is invalidated.
