Kness on 7/10/2023: Plaintiff has "struck out" under 28 U.S.C. 1915(g), but he filed this lawsuit just before incurring his third strike. The Court grants Plaintiff's application (Dkt. 3) for leave to proceed in forma pauperis, and the initial partial payment of the filing fee is waived. The trust fund officer at Plaintiff's place of incarceration is authorized to make deductions in accordance with this order as set forth below. The Court directs the Clerk to: (1) send a copy of this order to the facility having custody of Plaintiff (electronically if possible) and to the Court's Fiscal Department. Summonses, however, shall not issue. Upon review of Plaintiff's complaint (Dkt. 1) and "amended complaint" (Dkt. 4) (which amounts to an impermissible piecemeal amendment) under 28 U.S.C. 1915A, the Court dismisses this action as frivolous and malicious. See accompanying Statement for details. Plaintiff is advised that, in any future civil action or appeal he might bring while a prisoner, this dismissal may be counted as one of Plaintiff's three allotted dismissals under 42 U.S.C. 1915(g).
