June 27, 2023 Opinion or Order Filing 6 ORDER: The Court grants Plaintiff's application to proceed in forma pauperis #3 and authorizes the trust fund officer at Plaintiff's place of incarceration to deduct $22.87 from Plaintiff's account as the initial partial payment of the filing fee and continue making deductions in accordance with this order. The Court directs the Clerk to: (1) send a copy of this order of the facility having custody of Plaintiff (electronically if possible) and to the Court's Fiscal Department. The Clerk is also directed to: (1) file Plaintiff's complaint #1 ; (2) dismiss Defendant Chicago Police Department; (3) issue summonses for service of the complaint on Defendant Smith and the City of Chicago; and (4) send Plaintiff two blank USM-285 service forms, filing instructions, and a copy of this order. Plaintiff must complete and return a USM-285 form for service on Defendants. Failure to return the USM-285 form may result in dismissal of the unserved Defendant and dismissal of this case in its entirety. Plaintiff also must promptly submit a change-of- address notification if he is transferred to another facility or released. If Plaintiff fails to keep the Court informed of his address, this action will be subject to dismissal for failure to comply with a Court order and for failure to prosecute. The Court appoints the U.S. Marshals Service to serve Defendants. The Marshal is authorized to send a request for waiver of service to Defendants in the manner prescribed by Federal Rule of Civil Procedure 4(d) before attempting personal service.
