August 1, 2023 Filing 16 MINUTE entry before the Honorable Young B. Kim: In light of Plaintiff's position that he is ready to engage in settlement discussions now (R. 11 at 3), the court orders him to serve his settlement demand on Defendant by August 8, 2023, if he has not already done so. Defendant is ordered to respond to the settlement demand by August 15, 2023. If the parties believe that an early settlement conference would be productive, they should file a joint motion by August 22, 2023, to schedule a settlement conference. If there is no agreement on participating in a court-supervised settlement conference, the parties are ordered to adhere to the following written discovery schedule: (1) exchange Rule 26(a)(1) disclosures by September 1, 2023; (2) serve interrogatories and requests to produce documents by September 15, 2023 (requests to admit may be timely served before the end of fact discovery); (3) serve answers to discovery requests by October 13, 2023; (4) confer about the adequacy of the discovery responses by October 27, 2023; and (5) file a joint status report identifying each side's written discovery issues (must identify the specific interrogatories and requests to produce), along with the relevant discovery responses as exhibits, by November 3, 2023. The court will review the status report and resolve document discovery issues identified. The court will not consider general objections to discovery requests when ruling on discovery issues. If the parties do not have any disputed document discovery issues, a status report is not required. Pursuant to Rule of Evidence 502(d), this court orders that inadvertent disclosures of attorney-client privileged and attorney work materials will not constitute a waiver of the associated privilege. The court further orders that upon written notification (including emails) from the opposing side that an inadvertent disclosure has occurred, the party shall return and/or destroy the materials at issue or file a motion for a determination on the claimed privilege within seven calendar days of the written notification.
