July 11, 2023 Opinion or Order Filing 7 ORDER: Plaintiff's amended complaint #6 survives initial review pursuant to 28 U.S.C. 1915A, and it is accepted for filing. The Clerk is directed to: (1) file the amended complaint; (2) add Sheriff Thomas Dart as a nominal Defendant; (3) dismiss all other Defendants; (4) issue summons for service of the amended complaint on nominal Defendant Dart; and (5) send Plaintiff a blank USM-285 service form and a copy of this order. Plaintiff must return the completed USM-285 service form by August 11, 2023, or the matter may be dismissed for failure prosecute. The Court appoints the U.S. Marshals Service to serve Defendant. The U.S. Marshal is authorized to send a request for waiver of service to Defendant in the manner prescribed by Federal Rule of Civil Procedure 4(d) before attempting personal service. Plaintiff must promptly submit a change-of-address notification if he is transferred to another facility or released. If Plaintiff fails to keep the Court informed of his address, this action will be subject to dismissal for failure to comply with a Court order and for failure to prosecute. June 12, 2023 Opinion or Order Filing 5 ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The trust fund officer at Plaintiff's place of incarceration is authorized to deduct $5.00 from Plaintiff's account as the initial partial payment of the filing fee and to continue making deductions in accordance with this order as set forth below. The Court directs the Clerk to: (1) send a copy of this order of the trust fund officer at the facility having custody of Plaintiff (electronically if possible) and to the Court's Fiscal Department. Summons, however, will not issue. Plaintiff's complaint #1 is dismissed without prejudice because it fails to state a claim. Plaintiff is granted until July 14, 2023, to submit: (1) an amended complaint as detailed in this order, if he can do so consistent with Fed. R. Civ. P. 11; and (2) a completed USM-285 (Marshals service) form for each Defendant named in the amended complaint. Failure to submit the foregoing items by that date or to state a cognizable federal claim in any amended complaint will result in dismissal of this case. Plaintiff is advised that he must promptly submit a change-of address notification if he is released or transferred. If he fails to do so, this action will be subject to dismissal.
