Plaintiff moved for entry of default on 7/31/2023, after defendants failed to answer within 21 days of being served with the summons and complaint ( #6 , #7 ). Fed. R. Civ. P. 12(a)(1)(A)(i). The court required that any defendant objecting to plaintiff's motion for entry of default file an appearance or written objection by 8/11/2023. #12 . Federal Rule of Civil Procedure 55(a) states that "[w]hen a party against whom a judgment for affirmative relief is sought has failed to plead or otherwise defend, and that failure is shown by affidavit or otherwise, the clerk must enter the party's default." But if a "defendant appears and indicates a desire to contest the action, the court can exercise its discretion and refuse to enter a default." Charles Wright & Alan Miller, 10A Fed. Prac. & Proc. Civ. 2682 (4th ed. 2017). Defendants have had multiple opportunities to comply with the Federal Rules of Civil Procedure but have consistently failed to do so. For this reason, plaintiff's motion for entry of default #10 is granted.
