Filing 11 MINUTE entry before the Honorable Steven C. Seeger: Plaintiff's application to proceed in forma pauperis (Dckt. No. #3 ) is hereby denied without prejudice. Plaintiff did not complete the entire form. Plaintiff revealed that she is unemployed, but he did not complete the portion of the form asking when she was last employee (see question #1). Plaintiff also did not identify any assets, which makes the Court wonder how she can afford to live. Plaintiff must provide more complete information. The Court will give Plaintiff another chance. An updated application to proceed in forma pauperis is due by August 24, 2023. If the Court does not receive an update form by then, the Court will dismiss the case. As previously ordered (Dckt. No. #9 ), this Court took a preliminary look at the complaint, and concluded that it did not pass prescreening. So, as previously ordered, an amended complaint is due by August 24, 2023. Plaintiff's motion for attorney representation (Dckt. No. #4 ) is hereby denied. Plaintiff identified only one firm that she contacted. Plaintiff must do more to find an attorney on her own. Plaintiff's motion to have defendant pay all court fees (Dckt. No. #10 ) is hereby denied. That's not how the system works. A plaintiff brings a case, so a plaintiff has to pay the cost of bringing the case (or else file a successful application to proceed in forma pauperis). Mailed notice (jjr, ) |
Filing 10 MOTION by Plaintiff Antoinette C. Sellers that all court fees be paid by the defendant(s). (jh, ) |
Filing 9 MINUTE entry before the Honorable Steven C. Seeger: The Court took a look at the complaint in this new case, filed by pro se plaintiff Antoinette Sellers. The handwritten complaint is one page long. It appears to be about an attack at a Best Western Plus in St. Louis, Missouri in early November, 2022 (the complaint says "2023," which the Court takes to mean 2022.) It says: "Personal injury. Questionable wrongful death. Breach of contract." It goes on to say: "Unknown if baby dead or alive today. Was seven months pregnant at the time." The complaint cites a case number, and it also attaches a complaint filed in state court in Cook County, Illinois. That case, by the look of things, is ongoing. Overall, the filing raises a number of issues. For starters, the complaint does not allege enough facts to state a claim. This Court does not know what, exactly, the case is about, apart from the general outline. Also, it is not clear whether there is diversity of citizenship, so it is not clear if this case belongs here. And, there is a pending case in state court about the same thing. Plaintiff cannot pursue the same claim in two jurisdictions. Overall, the Court does not have enough to assess whether the complaint passes prescreening, which is necessary before this Court can resolve the application to proceed in forma pauperis. But the Court will give Plaintiff another chance. Plaintiff must file an amended complaint by August 24, 2023. Mailed notice. (jjr, ) |
