Filing 15 MINUTE entry before the Honorable Rebecca R. Pallmeyer: Plaintiff Kenneth McGahee filed suit against the CTA in 2019, No. 19 C 4574. Judge Gary Feinerman of this court noted concerns about the accuracy of information provided by Mr. McGahee in support of his motion for leave to proceed without prepayment of fees. Mr. McGahee did not satisfy those concerns, and Judge Feinerman dismissed the case. Mr. McGahee's new complaint appears to be largely identical to the one he filed in 2019, except that the 2019 complaint alleged that CTA violated his rights under the FMLA until 2017; the new complaint alleges that the wrongdoing took place from 2014 to 2018. A violation of Mr. McGahee's rights that occurred in 2018 appears to be untimely. Within 14 days, Mr. McGahee is directed to show cause why the case should not be dismissed for this reason. Mailed notice. (cp, ) |
