July 5, 2023 Filing 7 MINUTE entry before the Honorable Matthew F. Kennelly: The plaintiff in this case has filed a lawsuit against a residential facility where she lives. She alleges that her incoming mail has been tampered with. The Court grants plaintiff's motion to proceed in forma pauperis #3 but pursuant to 28 USC 1915(e)(2) dismisses her complaint for failure to state a claim. Tampering with the mail may be a federal crime as plaintiff contends. See 18 USC 1702. But that does not mean that a person may file a civil lawsuit in federal court for mail tampering. The statute that plaintiff cites is a criminal status and does not permit a person to bring a civil lawsuit for its violation. Rather any claim plaintiff may have against the facility for violating her privacy or tampering with her property is a state-law claim that must be filed in state court. The Court therefore directs the Clerk to enter judgment dismissing this case for failure to state a federal claim. Plaintiff's motion for attorney representation #4 is denied as moot.
