Date Filed Document Text
July 11, 2023 Filing 7 MINUTE entry before the Honorable Lindsay C. Jenkins: Plaintiff's purported jurisdictional statement is insufficient. The statement references "Zodiac Constitutional Rights," as well as 28 USC 1345 (actions where the United States is a Plaintiff); 28 USC 1357 (injury "for the protection or collection of any of the revenues, or to enforce the right of citizens of the United States to vote in any State); 28 USC 1356 (seizures by the United States on land or waters not within admiralty jurisdiction) and 28 USC 1368 (jurisdiction arising from unfair practices in international trade). None of these statutes provide a basis for subject matter jurisdiction concerning the events described in the Complaint, namely, an assault from 2019 that appears to have resulted in charges in a state criminal case. Because Plaintiff is pro se, the Court provides him with one last opportunity to explain the basis of the Court's federal subject matter jurisdiction. Failure to do so by August 1, 2023 will result in dismissal of this action without prejudice. Mailed notice. (jlj, )
July 5, 2023 Filing 6 JURISDICTIONAL STATEMENT by Stanley Vanzant (Exhibit) (Envelope not postmarked) (jg, )
June 15, 2023 Filing 5 MINUTE entry before the Honorable Lindsay C. Jenkins: On review of the complaint, R. 1, the Court issues this subject matter jurisdiction inquiry. The complaint contains various allegation against Mr. Vanzant's cousin arising out of an assault that occurred in 2019 in Chicago, Illinois. The complaint asks that criminal charges be pressed against Mr. Vanzant's cousin and seeks an award of $400,000. The Complaint includes other documents relating to the encounter, such as papers that indicate Mr. Vanzant has been charged in a criminal case in the Circuit Court of Cook County (19CR4270). On the Court's review, there is no apparent basis for federal subject matter jurisdiction because no federal law claim is asserted, nor is there any indication that there is diversity among the parties. The Plaintiff must submit a Jurisdictional Statement explaining the basis for federal subject matter jurisdiction by July 18, 2023, or else the case will be dismissed without prejudice. Mailed notice (smm)
