In light of the revised motion 11 to dismiss (which drops the limitations argument per R. 11), the prior motion 9 is terminated without prejudice. The briefing schedule is deemed to apply to the revised motion. The Court does suggest to the Plaintiff that the allegations on what happened are very generalized. It does not take much to adequately state an employment-discrimination claim, but something beyond "discipline" and "reassignment" is generally needed so that the employer is on general notice of the facts. The Plaintiff need not describe supporting evidence, but what discipline and what reassignment is being challenged? Instead of filing a legal brief in response, it might be best for the Plaintiff to file an amended complaint as of automatic right under Civil Rule 15(a)(1)(B) with those additional facts. (2.) On review of the status report, R. 14, discovery is paused for now.
